Lundbeck se compromete a salvaguardar los derechos de los pacientes, los socios del área de investigación y del negocio, y de nuestros empleados, de acuerdo con la legislación de datos personales vigente.

En esta política puede informarse de cómo Lundbeck procesa sus datos personales cuando navega en la web Lundbeck.com. Si accede a Lundbeck.com para aplicar a un puesto de trabajo o utiliza la línea directa de Compliance (como personal externo) lea por favor las políticas de privacidad específicas aplicables a estos servicios.

 

Cuando Lundbeck procesa datos personales recogidos a través de otras vías diferentes a la web, le informará específicamente sobre el tratamiento de los mismos. Sin embargo, puede ampliar información sobre actividades de procesamiento de datos específicos en la Sección 1.

1.  Procesamiento de datos personales de Lundbeck

Cuando acceda a Lundbeck.com y a los elementos relacionados, podremos procesar los siguientes datos personales que aparecen desglosados a continuación.

 The legal basis is consent, cf. Article 6(1)(a) of the GDPR or Lundbeck’s legitimate interest in providing you with the requested email notifications, cf. Article 6(1)(f) of the GDPR.

To continuously ensure the safety of our products we may disclose your personal data to relevant local health authorities, business partners and the Lundbeck Group companies.

The legal basis for the disclosure is:

a legal obligation in section 53 of the Danish Medicines Act and section 6 and 7 of the Danish executive order on the monitoring of adverse reactions from medicinal products which implements parts of Chapter 3 of Title IX  of Directive 2001/83/EC of the European Parliament and of the Council of 06 Nov. 2001, as amended by Directive 2010/84/EU of the European Parliament and of the Council of 15 Dec. 2010 cf. Article 6 (1) (c) of the GDPR;

to ensure high standards of quality and safety of healthcare and of medicinal products cf. Article 9(2)(i) of the GDPR.

criminal convictions: section 8(4) of the Danish Data Protection Act cf. Article 10 of the GDPR. It is Lundbeck’s assessment that the disclosure of criminal convictions is necessary for the medical and scientific assessment and to ensure high standards of quality and safety of healthcare and of medicinal products

 Personal data related to your subscription to  notifications for investors will be deleted immediately after you have unsubscribed from our service, unless storage for a longer period is required under applicable law.
Users of “contact us” form (PV)

If users of Lundbeck.com use our “contact form” for reporting on side effects and adverse events regarding our medicinal products (as patients), we will obtain the following data from the patient:

  • Contact information (name/initials, address, email address)
  • Country
  • Information on date of birth, age/age group, gender 
  • Information on health and medication 
  • Sex life/sexual orientation (only if reported and relevant*)
    *In general, this category of data is not specifically requested and collected but only captured and processed if reported in connection with an adverse event report and relevant for the medical and scientific assessment and evaluation of the case.
  • Criminal convictions/offences (only if reported and relevant*)
    *In general, this category of data is not specifically requested and collected but only captured and processed as part of an adverse event report related to a legal case or an insurance case or where the data relevant for the medical and scientific assessment and evaluation of the case.
  • Other personal data contained in the message or in the attached document

Healthcare professional and individuals reporting on behalf of patients:

  • Contact information (name/initials, address, email address)
  • Country
  • HCP profession/title (only HCPs)
  • Other personal data contained in the message or in the attached document

The source of data obtained in the “contact us” form (PV) is relative/individual or healthcare professionals reporting on behalf of you and publicly available sources such as websites or social media (in general, these sources are not monitored. Due to relevant regulation, Lundbeck employees that incidentally identify adverse events in publicly available sources (e.g. social media) are however obliged to report those to Lundbeck.

 It is a legal requirement that H. Lundbeck A/S collects and processes your personal data. We are obliged to register, monitor and analyse theadverse events that are reported to Lundbeck and to perform medical and scientific evaluation of any adverse event that may be related to a Lundbeck product. This is done to ensure high standards of quality, to enhance patient care and patient safety and to assess the risk-benefit profile of medicines.



The legal basis for Lundbeck’s collection and processing of your personal data is:

a legal obligation in section 53 of the Danish Medicines Act and section 5 of the Danish executive order on the monitoring of adverse reactions from medicinal products which implements parts of Chapter 1 and 3 of Title IX of Directive 2001/83/EC of the European Parliament and of the Council of 06 Nov. 2001, as amended by Directive 2010/84/EU of the European Parliament and of the Council of 15 Dec. 2010 cf. Article 6 (1) (c) of the GDPR;

to ensure high standards of quality and safety of health care and of medicinal products cf. Article 9(2)(i) of the GDPR; and

criminal convictions: section 8(3) of the Danish Data Protection Act cf. Article 10 of the GDPR. It is Lundbeck’s assessment that the processing of criminal convictions is (when relevant) necessary for the medical and scientific assessment and to ensure high standards of quality and safety of healthcare and of medicinal products.

Article 6(1)(f) of the GDPR.

 According to relevant pharmacovigilance legislation we are obliged to store your personal data for the lifetime of the product plus additional 10 years, as a minimum. However, the retention period of the personal data may be longer where union law or national law so requires.

2. Suministro de datos obligatorio / voluntario

Cuando recogemos datos personales directamente de usted, por ejemplo a través de la revista de Lundbeck o de las notificaciones de inversores, se ofrecen esos datos personales de forma voluntaria. No está obligado a darnos esa información. Las únicas consecuencias de no proveer los datos personales son que no podremos ofrecer el servicio o ayudarle con la petición que haya solicitado.

3.  El uso de Lundbek de los procesadores de datos

Lundbeck utiliza procesadores de datos (por ejemplo empresas de hosting, proveedores de IT, incluyendo fines para cookies, consultores, socios de negocio o miembros del Grupo Lundbeck), por lo que sus datos personales podrían ser transferidos, procesados y almacenados por estas terceras partes asociadas con Lundbeck, quienes procesarán sus datos en nombre de Lundbeck y le ayudarán con la provisión de contenidos y servicios que usa o solicita. Estos proveedores externos están obligados por Lundbeck a salvaguardar la confidencialidad de sus datos y a seguir las medidas oportunas técnicas y de organización para proteger sus datos de cualquier destrucción accidental o ilegal, pérdida o modificación,
revelación no autorizada o cualquier otro tratamiento ilegal.

 

4.  Transmisión de datos a países fuera de la UE / EEA

Podremos transferir sus datos a otro países, algunos de los cuales no están aún aprobados por la Comisión Europea con el nivel adecuado de protección de datos. Lundbeck se asegurará de que esas transmisiones se lleven a cabo de acuerdo con la correspondiente legislación de protección de datos, incluyendo la LGPD.

 

La transmisión a otros países fuera de la UE / EEA podría tener lugar si el receptor entra por las cláusulas contractuales estándar de la UE. La transmisión se puede hacer también por si el receptor se encuentra en un país con suficiente nivel de protección (consulte el listado completo de “países seguros” en la web de la Comisión de la UE). Si sus datos personales son transferidos a otras filiales de Lundbeck, la transmisión se englobará dentro de los Acuerdos intra grupo (o las Leyes corporativas vinculantes una vez implementadas). En cuanto a los datos PV[zDdlH1]  que Lundbeck transfiere a las autoridades de salud en los países fuera de la UE / EEA, se toma como base legal el artículo 49 (1) (d) de la LGPD (la transferencia es necesaria por razones clave de interés público).

5. Sus derechos como interesado

Lundbeck ha seguido todos los pasos necesarios y adecuados para proteger sus datos personales y asegurar sus derechos como interesado.

 

Según la LGPD y la Ley danesa sobre el procesamiento de datos personales, usted cuenta con determinados derechos descritos a continuación. Por favor tenga en cuenta que podrá experimentar ciertas limitaciones a la hora de ejercitar estos derechos.

Derecho de acceso

Tiene derecho a solicitar acceso a los datos personales que Lundbeck procesa sobre usted. Lundbeck debe proporcionar una copia de los datos personales como parte del proceso y como punto de partida, libre de cargos o por vía electrónica, si la solicitud ha sido procesada por un formulario electrónico habitual.

 

Derecho a rectificación

 Tiene derecho a rectificar o actualizar los datos personales que le incumban, incluyendo la cumplimentación de datos personales incompletos.

 

Derecho al olvido

Tiene derecho a la supresión de los datos personales que le conciernan.

 

Derecho a restricciones

Tiene derecho a restringir a Lundbeck en el tratamiento de los datos personales que le conciernan. 

 

Derecho a la portabilidad de datos

Cuando el procesamiento se basa en un consentimiento o un contrato y se lleva a cabo de manera automatizada, usted tiene derecho a recibir los datos personales que le conciernen en un formato organizado y legible en un dispositivo común. Tiene derecho a transmitir estos datos personales a un tercero sin interferencia por parte de Lundbeck, si resulta técnicamente posible.

 

Derecho a objetar

Tiene derecho a oponerse, por motivos relacionados con su situación particular, en cualquier momento al procesamiento de los datos personales que le conciernen, en base a intereses legítimos (como se establece en el Artículo 6 (1) (f) de la LGPD y la sección 6 de la Ley de protección de datos danesa, incluida la elaboración de perfiles basada en esta disposición. Una vez que haya ejercido este derecho a objetar, Lundbeck ya no debería procesar sus datos personales a menos que demuestre motivos legítimos convincentes para el procesamiento, que pueda anular sus intereses, derechos y libertades, o si el procesamiento es necesario para el establecimiento, ejercicio o defensa de la legalidad.

 

Cuando sus datos personales se procesan con fines de marketing directo, tiene derecho a oponerse en cualquier momento al procesamiento de éstos, lo que incluye la elaboración de perfiles en la medida en que esté relacionado con dicho marketing directo.
Cuando se oponga al procesamiento con fines de marketing directo, Lundbeck ya no debería procesar los datos personales para dichos fines.

 

Procesamiento con consentimiento

Cuanto el procesamiento de sus datos personales se lleva a cabo bajo su consentimiento, puede retirar ese consentimiento en cualquier momento. Tenga en cuenta que esta medida no tiene efecto retroactivo.

 

Presentación de una queja
